„Green Residence“ property owners: How long will we wait for Act 16? The manager replied

„Hello! This is an address to the Kasabovi family, Ana and Dimitar Kasabovi, and to the management of the „AMD Residence“ company.

How long, madam and sir, will you delay us? How long will we wait for you to do your job? How long will we be your hostages to your financial interests? How long will the Green Residence building not have Act 16? How long?

The city of Burgas learned about you! The whole Bulgaria will know! How long will we suffer?“

This is stated in an address of owners of properties in the residential building „Green Residence“ in the Burgas residential area „Slaveykov“, distributed to the media. In emails from them to our editorial office, they wrote:

„Hello, we are owners of apartments in the building „Green Residence“, „Slaveykov“ residential area, but we cannot use them because we are waiting for the second year to submit documents for Act 16, but it never happens. We are writing to ask for your help in making the situation public!“

„Hello, I am asking for your help, I am a single mother and have nowhere to live. I have paid for a place in this block of flats, but I am not allowed to move in for the second year.“

„I am writing to you in connection with a case with a building „Green Resisence“ (located in the „Slaveykov“ residential area in Burgas), which is being implemented by Ms. Ana Kasabova and Mr. Dimitar Kasabov. We are all organized and want to solve the problems and get into our apartments. We have been waiting for Act 16 for 2 years and there has been no green light so far. Through this email, we want to share about the situation so that more people can see it and no others are cheated by people like Kasabovi.“

Iskra.bg contacted one of the organizers of the address. According to him, the Detailed Development Plan for it /DDP/ started in 2017. The building permit is 2018. The whole building consists of three regulated land plots /RLP/, which required three separate building permits, but the building went in a package for Act 16. The first entrance is one RLP, the next 3 are second RLP and the last is a third RLP.

„The terms of the people from the first two land plots, who have signed contracts, were first promised to get Act 16 in 2020, then on January 9 there was a media story about them where the company „AMD Residences“ Ltd. promised that by the end of 2021 there will be Act 16. Owners in the last entrance were promised Act 16 in May 2022 and to this day there is none,“, he said, adding:

„Literally, the first contracts or all the contracts with the terms they signed are a lie. The reason – there is no way to conclude a preliminary contract in 2018 and promise that in 2020 or 2021 there will be Act 16, given that the last entrance in 2021 was still under rough construction. Deadlines have nothing to do with reality with objective reasons for this thing not to happen. That’s three land plots. All of them must be completed in order to obtain a complete building. And that is impossible. The owners of the first entrances were lied to that there was no problem, when in fact there was.“

„The other thing we are being lied to is that things are being delayed because of a street with parking spaces, which is basically municipal. The Municipality has issued them a construction permit on this street – they must fulfill it, and it must be municipal, so that they do not build a second level with underground parking spaces. That is, to come out cheaper. Subsequently, the Municipality got into trouble, because it turned out that the street turned out to be state-owned and they had no right to give permission for construction. Then they had to get better,“, he added, summarizing that after many tricks, in the end they all quarreled, and the owners stood and waited to enter to live in it. The building had Act 15, but due to documentation issues, they could not request Act 16.

 Manager of the company „AMD Residence“ Ltd., Ana Kasabova, told Iskra.bg that she is familiar with the address. On this occasion, her position is as follows:

„In 2018, we started selling, stopping and reserving a property with the so-called down payment, for a minimum amount. There was an advertising campaign for the upcoming, future construction of the building. The building has a total area of ​​30,000 square meters and this makes it one of the largest in the city of Burgas. Accordingly, the documentation for it is quite voluminous and heavy.

We got a construction decision for this building with a delay that was not due to us in August 2018. At that time, we did not have a document for the so-called superficies, which gave us a concession of the right of construction, so that we could start one because of the owner of the land, who had a claim for this to happen in 2019.

In 2019, we started construction with a site opening, and we already had a superficies. The actual construction started in February 2019.

In March 2020, the COVID pandemic began. By then, we had dug a hole of about 5 acres, poured the base concrete and started pouring walls. Due to the coronavirus, the delay is about 6 months.

We had to change the construction company and another one started doing the work. Despite this delay, the new construction company was able to handle the construction process quite quickly.

The construction process was completed in Act form 15 in 2021. This means a 100% completed building. It is signed by all participants – the Supervisory Company, architects, owners, etc.

In order to file the documents for Act 16, we had to have the report ready and be able to file it in category III in Sofia, in the Directorate for National Building Control /DNBC/. Supervision is the element in the whole system that guarantees the public interest and that controls the whole construction process. They signed Act 15 that this building is ready. Then they had the commitment under our contract to write the report and send it to Sofia. The delay started from 2021 until a few days ago because the street that we built was not put in place by the Municipality and the Supervisor that they chose with Act 16. And we have to attach that document. We have a commitment to build it, but the Municipality is the owner, and we only pay for it.

This is the practice of many municipalities – when an investor is interested in building – to also build infrastructure. Here the delay was huge.

The other delay came from the substation that EVN had to build and we can’t do it. EVN had to build a substation under a pre-contract they entered into with us before we signed building permit documents. And it doesn’t matter when it was built, because you need documents for that, and they were issued about a month and a half ago.

In Sofia, they will not look at when the street or the substation were built, but the documents for them.

We also changed the Supervisory company because it collapsed. This takes about 2 months. We concluded a contract with the new one, who a few days ago confirmed the project act, that he already has all the documents and it is a matter of a week or two that it will be ready, so that we can enter it into DNBC-Sofia.

According to the law, the recommended period in which a commission appointed by DNBC-Sofia will come is 3 months. That is, everything now depends on DNBC-Sofia and whether it will comply with this recommended deadline. This is our family business and in no way do we want our customers to feel harmed in any way. From Act 15 onwards, things are not up to us and we have actually been building from 2019 to 2021. And we have built it. We spent 2 years gathering documents.

Act 16 is prepared within about 10 days. I have no worries that the building will not be able to pass because we have met the requirements. EVN should then come and tie the boards to the flats.

The owners are aware of everything that has been said so far and I will continue to keep them informed.“
