Today, the investigative report declaring the illegal extension of the pier in front of Ahmed Dogan’s summer shed was delivered to a representative of the company that owns the facility. This was confirmed by the Directorate for National Construction Control (DNCC) for Iskra.bg.

From there, they specified that from July 6, the 7-day procedure begins, in which the affected parties can file objections. They may contain documents that have been requested but not yet submitted.

We remind you that the conclusion of illegal construction was made on the basis of a series of missing documents. For the object built by the Hermes Solar company, no approved project has been submitted, no construction permit has been issued, and there is no protocol for determining the construction site. The construction line and level have not been determined, and no order book has been presented. Only a detailed development plan, approved by order of the Deputy Minister of the Ministry of Regional Development and Public Works in 2019, is presented.

According to the next step of the procedure, DNCC officials will consider the objection, if any. In the event that they accept that it is not justified, a Removal Order will be issued.

However, the party to which it was issued may decide to challenge it in court, as it has done with other buildings in the complex.

The court then considers whether to uphold the Removal Order, and in the event that it does, the illegal pier will be pushed. First, the Directorate of National Building Control will issue an invitation to voluntarily remove the firm and then, if it fails to do so, it will proceed with compulsory removal. The costs for him will be collected by court order, as it is a serious amount.

The Directorate also commented that the inspection, which was carried out to ascertain whether there was a violation, was initiated by order of the Deputy Prime Minister and Minister of Regional Development and Public Works, Grozdan Karadjov, who announced on Facebook last night that there are no untouchables.

We remind you that in March the Directorate for National Construction Control disseminated information from which it is clear that the extension of the quay wall in the Rosenets Forest Park was built without the necessary construction documents after an inspection of documents and on the spot by order of Minister Karadjov.

At that time, the State Building Control did not find construction documents in the municipality of Burgas, nor requests for the issuance of a construction permit for the reconstruction and extension of the „Keyova Stena“ hydrotechnical facility, built in the Black Sea area. With the amendment of the cadastral map in 2020, the area of ​​the quay wall was increased from 1029 square meters to 5838 square meters according to the provided cadastral sketches. According to them, the site is a land property. The Bureau of Geodesy, Cartography and Cadastre in Burgas has issued a sketch of the property intended for a port, with registered owner „Hermes Solar“ OOD, according to a notary deed of 2020. It states that the property consists of two main parts – northern and western, built in two stages in the Black Sea area in the 1970s and 1980s.

During the on-site inspection by DNCC, it was established that the site „Way wall“ is a reinforced concrete retaining wall – a breakwater and a reinforced concrete pier with an „L“ shape. The approximate length of the facility is 280 meters and consists of a northern part with an approximate length of 175 m and a western part with an approximate length of 105 m. From the inspection of the site it is clear that about 50 m of the northern, long part of the quay wall is old construction. The concrete has collapsed and in places there is exposed, heavily corroded reinforcement. A new concrete pavement has been laid on it. The new construction is the entire short part and about 125 m of the long part of the quay wall. This is confirmed by cadastral sketches and satellite images. The necessary building documents, including a building permit, have not been found for the new construction.

As a result of the inspection, the Directorate for National Building Control commissioned external specialists to carry out a detailed survey, including the underwater foundation of the Keyova Stena property. Based on the data from the survey, subsequent legal actions were taken in the case, namely the issuance of the Constitutive Act.
